Right of withdrawal and data protection
For the business relationship between RADAR-SHOP and the customer, the following general terms and conditions apply exclusively in the version valid at the time of the order. Radar-shop.com does not recognize deviating conditions of the customer unless radar-shop has expressly agreed to their validity in writing.
2 conclusion of contract
Your order represents an offer to us to conclude a purchase contract. When you place an order with radar-shop, we will send you an email confirming that we have received your order and listing its details (order confirmation). This order confirmation does not constitute acceptance of your offer, but is only intended to inform you that we have received your order. A sales contract is only concluded when we send the ordered product to you. Contract partner is RADAR-SHOP. In the event of typing, printing or calculation errors on the website, radar-shop.com is entitled to withdraw.

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods. Consequences of the withdrawal
If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. We can refuse the repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.
You must return or hand over the goods to RADAR-SHOP, Waldhofer Strasse 102, D-69123 Heidelberg, Deutschland / Germany, immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract . The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You must pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.
Unless otherwise agreed, delivery takes place from the radar-shop warehouse to the delivery address specified by the customer. On the website you will find information on the availability of products that are sold directly by radar-shop (e.g. on the respective product detail page). We would like to point out that all information on availability, shipping or delivery of a product are only approximate information and approximate guide values. They do not represent any binding or guaranteed shipping or delivery dates, unless this is expressly designated as a binding date in the shipping options for the respective product. If, while processing your order, radar-shop determines that the products you have ordered are not available, you will be informed separately by e-mail. If radar-shop.com is unable to deliver the ordered goods through no fault of its own, because the supplier of radar-shop.com does not fulfill his contractual obligations, radar-shop.com is entitled to withdraw from the contract with the customer. In this case, the customer will be informed immediately that the ordered product is not available. The legal rights of the customer remain unaffected.
If delivery to the customer is not possible because the customer cannot be found at the delivery address specified by him, although the delivery time has been announced to the customer with a reasonable period of time, the customer shall bear the costs of the unsuccessful delivery.
5 Due Date and Payment, Default
The customer can pay the purchase price by cash on delivery, prepayment, credit card, Giropay, Sofortüberweisung.de. If the customer is in default of payment, radar-shop is entitled to demand default interest of 5% above the base rate announced by the European Central Bank. If radar-shop.com has verifiably incurred higher damage caused by default, radar-shop.com is entitled to assert this.
6 Offsetting, retention
The customer is only entitled to offset if his counterclaims have been legally established or are undisputed by radar-shop.com. In addition, he is only authorized to exercise a right of retention if his counterclaim is based on the same contractual relationship.
All prices include the applicable VAT.
8 Reservation of Title
The delivered goods remain the property of radar-shop until they have been paid for in full.
9 Liability for Defects
If there is a defect in the purchased item, the statutory provisions apply. The assignment of these claims by the customer is excluded.
If the supplementary performance has been made by means of a replacement delivery, the customer is obliged to return the goods initially delivered to radar-shop within 30 days at the expense of radar-shop. The return of the defective goods must be carried out in accordance with the statutory provisions. Radar-shop reserves the right to claim damages under the legally regulated conditions.
The limitation period is twenty-four months from delivery.
Radar-shop has unlimited liability insofar as the cause of the damage is based on intent or gross negligence.
Furthermore, radar-shop is liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance you regularly trust. In this case, however, radar-shop is only liable for the foreseeable, contract-typical damage. radar-shop.com is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
The above limitations of liability do not apply in the case of injury to life, body and health, for a defect after assuming a guarantee for the quality of the product and for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
As far as the liability of radar-shop is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.
10 Data protection, collection, processing and use of personal information from our customers
The customer has been informed about the type, scope, place and purpose of the collection, processing and use of the personal data required for the execution of orders by radar-shop. The customer expressly consents to this collection, processing and use of personal data.
We would like to point out that data transmission over the Internet (e.g. when communicating by e-mail) can have security gaps. A complete protection of the data against access by third parties is not possible. Confidentiality with regard to the data protection regulations is given under the data protection declaration given here in accordance with DGSVO (EU Directive 2016/679).
Further information on the type, scope, location and purpose of the collection, processing and use of the personal data required for the execution of orders by radar-shop can be found in the data protection declaration.
Confidentiality with regard to data protection regulations is only guaranteed under the above restriction. In particular, all communications of personal data via the Internet should only be made if the rights of third parties are not affected. Unless the third party has also given its consent with knowledge of the above security gaps. The site operator is not liable for any damage or injunctive relief resulting from such security gaps.
11 Applicable Law
German law applies to the exclusion of the UN Sales Convention (CISG).
12 Liability for content
